These Terms and Conditions govern your use of Edwrk Limited&s website, located at edwrk.com. Please read these terms thoroughly. Your access and use of the website indicate your acceptance of these terms. If you do not agree, kindly refrain from using the website.
1. General Terms
Edwrk serves both Users seeking educational services (“Students”) and Users providing educational services (“Educators”). The term “User” refers to Students, Educators, or any person interacting with the site. These Terms bind all users upon (a) accessing the content of the site; (b) contacting Educators or receiving educational services through the site; or (c) acknowledging agreement with these Terms.
2. Privacy Policy
Refer to Edwrk&s Privacy Policy to understand how we collect, use, and disclose your information.
3. Services
Edwrk is a marketplace connecting Students and Educators. Educators, as independent businesses, handle all aspects of the services they provide. Students should investigate Educators& credentials and reviews before engagement. Educational services involving students under 18 should be supervised by an adult.
4. Academic Honesty
Edwrk promotes learning, not cheating. The site must not be used for academic dishonesty, including taking quizzes or completing assignments against academic policies.
5. User Obligations and Conduct
Users must be of legal age and provide accurate and updated Registration Data. Users are responsible for all content they create on the site and must ensure it aligns with legal and ethical standards. Unauthorized and offensive content is prohibited.
6. Content and Advertisements
Content provided to Edwrk is subject to unrestricted use or dissemination. Users grant Edwrk a worldwide, royalty-free license to use such content. Advertisements and promotions from third parties may appear on the site, with Edwrk not responsible for any dealings with such third parties.
7. Termination and Suspension
Edwrk reserves the right to suspend or terminate any User without notice at its sole discretion. Suspended or terminated Users must cease using the site immediately.
8. Disclaimer of Warranties and Limitation of Liability
The site is provided “as is”. Edwrk disclaims all warranties, express or implied. Users assume all risks associated with using the site. Edwrk isn&t liable for any damage or loss resulting from User interactions and transactions.
9. Transaction Terms
Users must follow Edwrk&s payment policies and pay all associated costs through Edwrk. Costs include the educator&s hourly rate, service fee, and the platform fee agreed between the Educator and Edwrk.
10. Service Agreement
Payment processing services for Educators on Edwrk are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these terms or continuing to operate as an Educator on Edwrk, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Edwrk enabling payment processing services through Stripe, you agree to provide Edwrk with accurate and complete information about you and your business, and you authorize Edwrk to share it and transaction information related to your use of the payment processing services provided by Stripe.
11. Recipient Service Agreement
Edwrk uses Stripe to make payouts to Educators. The Stripe Recipient Agreement applies to your receipt of such Payouts. To receive payouts from Edwrk, you must provide Edwrk with accurate and complete information about you and your business, and you authorize Edwrk to share it and transaction information related to your payout with Stripe.
12. Text Message Notifications
Users can opt-in for text message notifications and may opt-out at any time. Standard data and messaging rates may apply.
13. Governing Law
These Terms are governed by the law of New York, United States. Users submit to the exclusive jurisdiction of New York courts.

Note:
Edwrk operates from Jamaica and the United States and does not guarantee accessibility or availability of services in all locations.
Edwrk does not conduct direct background checks on Users. Users are responsible for verifying the eligibility and credibility of other Users.
All users, especially those under the age of 13, are expected to use the Site under the supervision and consent of a legal guardian or parent.
15. User Safety and Verification
While Edwrk does not conduct direct background checks, we encourage Users to perform their own investigations into the eligibility and credibility of other Users. We provide optional background check services for Educators, and Students are encouraged to report any misconduct or suspicious activities to Edwrk for review.
16. Refund Policy
Edwrk&s refund policy allows for refunds under specific conditions. Refund requests must be made within 30 days of the service date and will be reviewed on a case-by-case basis. Refunds may be issued if the service was not delivered as agreed, if there was a significant quality issue, or for other valid reasons as determined by Edwrk.
17. Dispute Resolution
In case of disputes between Users, Edwrk offers mediation services to help resolve issues amicably. If mediation fails, disputes may be escalated to arbitration. Users agree to binding arbitration in accordance with the rules of the American Arbitration Association for any unresolved disputes.
18. Intellectual Property
All intellectual property created by Users on Edwrk, including but not limited to course materials, remains the property of the respective Users. However, by posting content on Edwrk, Users grant Edwrk a non-exclusive, royalty-free license to use, distribute, and display the content on the platform.
19. Accessibility
Edwrk is committed to making the website accessible to users with disabilities. We strive to comply with relevant laws and standards, including the Web Content Accessibility Guidelines (WCAG). Users with accessibility needs are encouraged to contact us with any feedback or requests for accommodations.
20. Changes to Terms
Edwrk Limited reserves the right to change these terms at any given time. Users& continued access to and use of the website constitute acceptance of the updated terms. If you disagree with the updated terms, please discontinue using the website.
21. Indemnification
Users agree to indemnify and hold Edwrk Limited harmless from any claims, losses, or damages, including legal fees, resulting from their violation of these terms and conditions, their use of the Site, or their placement of any content onto the Site, and to fully cooperate in Edwrk Limited&s defense against any such claims.
